Family Law Transfers

Transfers of ACT/NSW land ownership under Court orders or binding financial agreements.

Our Service

Need Help?

At Namadgi Legal, we assist clients to transfer title to ACT/NSW land where there is a court order for transfer of property or a binding financial agreement.

While a court order or agreement determines the legal entitlement to property, it does not automatically update the ownership records.

To complete the transfer, the title must be formally conveyed in the same was as if it was sold. Most of the time, this can be done online through the eConveyancing platform PEXA, and you will need representation. Sometimes in the ACT, more old-fashioned paper-base processes are necessary. The process also requires changes to existing loan arrangements, and administrative formalities including government forms.

Our experienced solicitors provide end-to-end support with:

  • Interpreting and implementing court orders and binding agreements for property transfer
  • Arranging to pay-out and close existing loan accounts, to receive new loan funds, and to make payments to a former spouse.
  • Preparing title transfer documentation, and either attending to registration or co-ordinating registration with a relevant lender.
  • Arranging applications for stamp duty exemptions or concessions available.
  • Fantastic communication, and a superior service.

We understand that property transfers following legal proceedings can be time-sensitive and sometimes emotionally charged. Namadgi Legal is committed to delivering clear, efficient, and compassionate legal support to help you finalise your property arrangements with confidence. However, we do not practice family law, and will refer any disputes back to your family lawyer.

If you’ve received a court order for transfer of property and need assistance with conveying title, contact Namadgi Legal today.

Prices starting from $550 inc GST plus disbursements at cost.
